This course is designed to educate attendees on how to create and properly maintain an Employee Handbook with specific emphasis on the notice, education, and procedural requirements an employer must adhere to when testing for drugs and alcohol pursuant to Florida law and those rules promulgated by Florida’s Agency for Health Care Administration. Contractors and home builders in attendance will learn what provisions and terms must be included within an Employee Handbook, and how to properly administer and enforce an employer’s Drug-Free Workplace Policy in accordance with Section 440.102, Florida Statutes. Attendees will receive instruction on those mandatory employment rules and policies which must be contained within any Employee Handbook, such as, [1] employment classifications of specific workers, [2] equal opportunity clauses, [3] disability accommodation language, [4] HIPPA privacy laws, [5] the use and maintenance of company property, [6] time-keeping procedures, [7] overtime pay, [8] employee safety and health, [9] family and medical leaves of absence, and [10] workers compensation coverage, limitations, and claims. Finally, attendees will learn how to craft a Drug-Free Workplace Policy to include within any Employee Handbook in order to properly educate employees on the prohibition against the use of drugs and alcohol in the workplace, Florida’s laws on an employer’s authority to administer drug testing during employment, the drug testing procedures to be used by the employer, and the confidentiality laws in place to protect both employer and employee.
